Privacy Statement

The protection of your privacy in the processing of your personal data is an important concern to which we pay special attention during our business processes. Personal data collected during visits to our websites are processed by us confidentially and according to the legal provisions. Data protection and Information security are part of our company policy. Exceptions to this rule are local partners, which take over the processing of your request.

1. Who is responsible for the processing of my data?

2. When and why is EMS collecting data?

Your data is collected to accomplish a contract in compliance with art. 6 par. 1 b DS-GVO. We have reduced the mandatory items to the absolute minimum necessary for making contact.

In the first contact phase we just collect data necessary for contract initiation:
mandatory fields: title, last name, email
optional fields: first name, company, phone, fax

To execute a contract more detailed customer data is necessary. Usually we collect missing data from customer orders. If this data is not sufficient, we question the customer directly. Data collected in the process of contract execution is:
Main address (billing address), p.r.n. shipping address, UST-ID-Nr. / VAT-Nr.

Furthermore contact persons in the responsible departments (e.g. purchase, development, commercial, administration) and the soled products are saved. This is necessary for contract execution referring to art. 6 par. 1 b DS-GVO and for service in case of failure (after sales service).

If a customer wishes, customer number(s) of transport companies will be saved and used for shipping of articles. If no such wish is mentioned, we will handle over customer data to our carrier company. This is also necessary to execute the contract in compliance with art. 6 par. 1 b DS-GVO.

3. Duration saved privacy data

EMS is producing long lasting components for automation techniques. In case of failure fast reaction is crucial, hence longtime storage of data is necessary. In past years EMS was able to reduce machine downtime significantly by analyzing customer data. Taking this in account we think longtime storage of customer data is in best interest of our customers.

After collection your data is stored as long as necessary to fulfill our legal duty referring to Handelsgesetzbuch, Abgabenordnung, Kreditwesengesetz and Geldwäschegesetz. The legal storage period for documents is up to ten years.

4. Collection and Processing of Personal Data

When you visit our websites our web server automatically records the name of your internet service provider, the website from which you visit us, the websites you actually visit and the date and duration of your visit. EMS may use cookies and active components (e.g. JavaScript) to follow the preferences of our visitors and optimize our websites accordingly. You can reset your browser either to notify you when you receive a cookie, or to refuse to accept cookies. It is also up to you if you prefer to disable JavaScript. Please note that certain areas of some sites may not function properly if you reject a cookie or disable JavaScript.

Web-Statistics with Matomo

We are using a tool named Matomo (formerly known as Piwik) on our sites. This tool enables us to get statistics in which way the users are browsing our sites and also how we can make your browsing experience better. This data is collected using JavaScript and Cookies, but is only stored on our secured servers. Noone, not responsible for data security and analysis, within the EMS group will ever have access to this data. You are able to reject the collecting of this data by disabling JavaScript and Cookies. The Usability will decrease a bit, but you are able to access all parts of the EMS internet sites.

Additional personal data is only stored if volunteered by you, for example in context of a registration, a request for information, a download request or in request for a contact.

Saving of Cookies

EMS uses cookies for product reservations later used in request (wish list). This means that those cookies are deleted, after you leave the website. Piwik like described above also uses cookies to generate visitor statistics. We are not able to erase these cookies, responsible for this task is your browser. Most browsers can be configured to delete cookies in their preference menu. Cookies are not crucial to use this website. There are just some functions you won’t be able to use. The basic usability is still in place.

Cookies are small text files, which are stored on your PC and your browser saves automatically. Cookies don’t harm your PC and don’t contain viruses.

Use and Disclosure of Personal Data and Purpose Specification

EMS will use your personal data for the sole purpose of technical administration of the websites, customer administration (emailings) and marketing (newsletter), only to the extent necessary in each specific case. Your personal data will not be disclosed to third parties outside the Dr. Wünsche company group without your consent.

5. Data transfer to third parties

There is no case in which stored data is soled or handled over to third parties, if we are not forced to do this by law. An exception of this rule are partner companies, which take over your request.

In such case of transfer of your contact data you will be informed. All right described after this paragraph, especially the right to recall and contradict referring to art. 7 par. 3 DS-GVO stay in place. If you want to make use of these rights we will control their execution in our partners’ it systems as far as possible.

6. Data Security Rights

Anytime you have the right of information about all data saved regarding your person, in particular data source, data receiver and purpose of the data.

If the data we have saved regarding your person is wrong or outdated, you have the right to force correction of this data.

Every user has the right to recall data procession, referring to art. 6 par. 1 e or f DS-GVO, anytime and without mentioning reasons. This can be done by email using the address or using the telephone DID +49/8441/4902-60. An appropriate hint is part of every EMS e-mail.

Furthermore you can demand the deletion of your data. If the deletion of this data is not possible, cause other laws force us to store them, your data is locked and their use is limited to legal purposes.

Finally you have the right to raise a complaint about us at the responsible data security controlling institution. You can use this right at a controlling institution in the member state your living in, or where your working place is located, or at the location of the essential breach. 7. Right to recall and contradict

Referring to art. 7 par 3 DS-GVO you have the right to recall and contradict an approval of the part every time. This has the effect, that we are no longer allowed to proceed with the data processing followed by this approval. The recall of an approval does not effect legality of data processing happened so far.

If we are processing your data cause of justified interests referring to art. 6 par. 1 f DS-GVO, you have the right to contradict referring to art. 21 DS-GVO. This is the case if there are reasons, related to a special situation or the contradicting is stated against direct marketing. In case of direct marketing we grant a general right of contradiction, which will be executed as soon as possible.

To use your right to recall and contradict a message through one of the contact possibilities mentioned above is enough.

8. Security

EMS uses security measures in order to protect the data we have under our control against manipulation, loss, destruction, access by unauthorized persons or against unauthorized disclosure. Our security procedures are continually enhanced as new technology becomes available.
